Mediation is a valuable tool for settling many family law and divorce cases. It is less formal and intimidating than a courtroom trial, so people are usually more relaxed. In many instances, too, it takes less time and costs less money than a trial. Divorce mediation is required for a contested divorce.

How Mediation Works

A mediator does not have the authority to make a decision; he or she is there to help the people involved work toward their own agreement. Mediation focuses on identifying issues and solving problems, not determining who is right or wrong. Each party has the chance to make statements and then have a joint discussion.

There is also time for individual conversations with the mediator to discuss the case. Joint negotiation may then take place and, if a solution has been reached, the mediation is concluded. If the parties do not reach an agreement, the mediator can suggest further mediation, arbitration or going to trial.
