Restraining Orders, Protective Orders and Injunctions

Filing an Injunction for Protection can order a person charged with domestic violence to stop the violence or harassment and to stay away from the person seeking protection, as well as that person's home and place of work. Failure to abide by the injunction can result in a criminal violation of the order, with penalties — sometimes quite heavy penalties — assessed. An injunction can also provide for temporary child custody, visitation, and child or spousal support.

An Injunction for Protection Against Domestic Violence protects a person from abusive members of her (or his) family or household. A filing party may file for an Injunction for Protection Against Domestic Violence after just one incident. There are also:

  • Petitions for Injunction Against Repeat Violence
  • Petitions for Injunction Against Dating Violence
  • Petitions for Injunction Against Sexual Violence

All these petitions may also be filed on behalf of a child under age 18 living at home. If you need help with a petition, I can file one for you and gather the evidence necessary to support your case.

Continued Help Throughout the Process

Filing the initial Injunction for Protection is sometimes not enough. You may need assistance if the party filed against violates the injunction (contempt) or if you need to extend the length of the injunction. I can handle all related parts of your case, including filing for divorce if you decide to do so.

Have You Been Charged With Domestic Violence?

Domestic violence allegations and responses occur within an area of the law that is, by its very definition, volatile and often charged by strong human emotions. It is certainly true that a great many people frequently need the protection that law accords against acts of domestic violence.

It is also true that persons facing allegations of domestic violence have a need and legal right to respond and defend themselves. In certain cases, ambiguity is present. Facts might not be clear, motives might be suspect, the truth of the charge itself might be in question — a respondent might be innocent. If you need criminal defense against these charges, please contact me.
